Terms of Service

These terms govern your access to and use of Periscope ("Periscope", "the service"). Periscope is operated by Periscope Social (ABN 92 241 934 532). By creating an account or using the service, you agree to them.

1. The service

Periscope is operated by Periscope Social (ABN 92 241 934 532).

Periscope is a subscription software service for social media analytics and insights. You connect supported platforms, view dashboards and reports, and use features such as Ask AI and Benchmark Scorecard depending on your plan.

Our marketing site is at periscope.social. The product is accessed at portal.periscope.social.

2. Who may use Periscope

You must be at least 18 years old and able to form a binding contract. If you use Periscope on behalf of a company or other organisation, you confirm you have authority to bind that organisation to these terms.

You are responsible for everyone who accesses the service through your account or workspace, including team members you invite.

3. Accounts and workspaces

You must provide accurate account information and keep your login credentials secure. Notify us promptly if you suspect unauthorised access.

Each workspace belongs to an organisation. Owners and admins control billing, team access, connected accounts, and workspace deletion. You can manage these from Settings → Organisation in the portal.

4. Subscriptions, trials, and billing

Paid plans are billed in advance on a monthly or annual cycle unless stated otherwise at checkout. Prices, seat limits, and included features are described on our pricing page and in your plan summary.

Some plans include a free trial. When a trial ends, your selected plan is billed unless you cancel before the trial period ends. Trial eligibility and length are shown at checkout.

Payments are processed by Paddle. We do not store full card numbers on our servers. By subscribing, you authorise recurring charges until you cancel.

You may cancel from organisation billing settings or through your payment provider's customer portal where available. Cancellation stops future charges. It does not automatically entitle you to a refund for amounts already paid. See our refund policy for refund rules.

We may change plan prices or features. We will give reasonable notice before price changes apply to an existing subscription, and you may cancel before the change takes effect.

5. Connected platforms and your data

When you connect a social platform, you grant Periscope permission to access analytics, posts, and related metadata through that platform's API on your behalf. You confirm you have the rights to connect each account and to use the data in Periscope.

You must comply with each platform's terms and policies. We are not responsible for actions those platforms take against your accounts.

Our Privacy Policy explains how we collect, use, and retain personal information and workspace data.

6. Acceptable use

You agree not to:

  • Use Periscope for unlawful, fraudulent, or harmful purposes
  • Attempt to gain unauthorised access to the service, other accounts, or our systems
  • Reverse engineer, scrape, or overload the service except as allowed by law
  • Resell or sublicense the service without our written permission
  • Upload malware or interfere with the integrity or performance of the service
  • Use Ask AI or other features to generate content that violates law or third-party rights

We may suspend or terminate access if we reasonably believe you have breached these terms or pose a security or abuse risk.

7. AI-assisted features

Ask AI, onboarding setup, insights, and similar features use automated models. Outputs are generated from your connected data and prompts. They are for information and decision support only, not professional, legal, or financial advice.

You are responsible for reviewing AI output before you act on it. We do not guarantee accuracy, completeness, or fitness for a particular purpose.

8. Intellectual property

We own Periscope, including software, design, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the service during an active subscription or trial, subject to these terms.

You retain ownership of your content and data. You grant us a licence to host, process, display, and analyse that data solely to provide and improve the service.

9. Confidentiality and security

We implement measures designed to protect customer data, as described in our Privacy Policy. You are responsible for configuring access within your workspace and for protecting credentials for connected platforms.

10. Disclaimers

The service is provided on an "as is" and "as available" basis to the extent permitted by law. We do not warrant uninterrupted or error-free operation, or that analytics from third-party platforms will always be complete or current. Platform APIs and data availability are outside our control.

11. Limitation of liability

To the maximum extent permitted by law, Periscope and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us for the service in the 12 months before the claim, or (b) AUD $100.

Some jurisdictions do not allow certain limitations. In those cases, our liability is limited to the fullest extent permitted by applicable law.

12. Indemnity

You will indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the service, your connected data, your breach of these terms, or your violation of third-party rights or platform policies.

13. Termination

You may stop using Periscope at any time by cancelling your subscription and, if required, deleting your workspace. We may suspend or terminate access for breach, non-payment, or if we discontinue the service with reasonable notice where practicable.

Sections that by nature should survive termination (including payment obligations, intellectual property, disclaimers, limitation of liability, and indemnity) continue to apply.

14. Changes to these terms

We may update these terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may also be communicated by email or in-product notice. Continued use after changes take effect constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules. Courts in New South Wales have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you the right to bring proceedings elsewhere.
